Definitions

In these terms and conditions, the following words have the following meanings:

Claim means any claim, cause of action, Liability, demand, action, remedy, suit, injury, indemnity, damage, proceeding, litigation, investigation or judgment whether based in contract, tort, statute or otherwise whether present, unascertained, immediate, future or contingent.
Eligible Member means Members that are:
- individuals and are eighteen (18) years or older;
- Australian residents; and
- are not an Excluded Member;
Excluded Member means employees of NeoWorld, their immediate family, including parents, spouse, domestic partner, siblings and children, or any other person residing in their household;
Giveaway Partner means NeoPro Cycling Pty Ltd ACN 638 661 971;
Liability means any liability or obligation (whether actual, contingent or prospective), including for any Loss irrespective of when the acts, events or things giving rise to the liability occurred.
Loss means any loss (including consequential loss), damage (including indirect or consequential loss), compensation, fine, penalty, charge, payment, cost or expense (including legal costs on a full indemnity basis) however it arises and whether it is present or future, fixed or unascertained, actual or contingent.
Members has the meaning given to it by the Membership Terms and Conditions located at https://neoworld.websolutions.pp.ua/terms-of-use/
Membership means the on-going subscription to the NeoWorld detailed at https://neoworld.websolutions.pp.ua/terms-of-use/;
Membership Giveaway means any trade promotion conducted by Us;
NeoWorld means NeoWorld Pty Ltd ACN 674 654 007 and We, Us and Our has a corresponding meaning;
Terms and Conditions means these terms and conditions and also includes the:
- Privacy Policy;
- Website Terms of Use; and
- Membership Terms and Conditions;
Website means www.neoworld.com.au and associated social media platforms operated by us or on our behalf;

Giveaway

NeoWorld is conducting a Membership Giveaway for the prize specified in clause 2.2 (‘Giveaway’) which commences on the 15 June 2024 at 12.01am AEST and will conclude on the 23 June 2024 at 5.00pm AEST (‘Giveaway Period’).

The prize is one (1) JetBlack Smart Trainer valued at $500.00.

Eligible Members are automatically entered into the Giveaway (‘Entrant’).

There is no limit on the number of entries each Entrant can hold.

NeoWorld reserves the right to disqualify Entrants in the event of non-compliance or breach of the Terms and Conditions.

Entrants agree to provide photographs or other media with prizes won in the Giveaway as reasonably requested of them and also permit us to film content of them with the prize for reasonable promotional purposes.

By entering the Giveaway, Entrants agree not to make any defamatory or derogatory comments about NeoWorld, the Giveaway or any prizes or anything incidental to the Giveaway.

The Draw

The Giveaway draw will take place at 8.00pm AEST on the 23 June 2024.

The draw will be conducted by a random number generator and the winner will be the Entrant with the corresponding ticket number.

The winner will be contacted within twenty-four (24) hours via phone and email. The winner will be published on the Website and social media within seven (7) days of the draw for at least twenty-eight (28) days.

Prizes can be claimed by contacting Us via email and providing photo identification.

If the prize remains unclaimed and We cannot contact the winner after ninety (90) days from the date of the draw, the winner will forfeit the prize and the prize will be subject to a redraw on 30 September 2024 at 8.00pm AEST.

Any redraw will be conducted in accordance with clause 3.2 and the winner will be contacted within twenty-four (24) hours via phone and email. The winner will be published on the Website and social media within twenty-four (24) hours of the redraw.

Prize

The winner is solely responsible for paying duties, taxes or fees, except for delivery costs, in connection with the prize.

To the extent permitted by law, the winner accepts the prize on an ‘as is basis’. NeoWorld must be notified of any issues or imperfections with the prize within twenty-four (24) hours of delivery of the prize. After this time, the winner is deemed to have accepted the prize.

NeoWorld will arrange delivery of the prize Australia-wide within twenty-one (21) days of announcing the winner subject to logistics and transportation availability.

We will only transfer prizes to the person named on the Membership, subject to the production and verification of valid photo identification. Identification considered suitable for verification is at the discretion of NeoWorld.

NeoWorld does not provide any warranty in relation to the use or suitability of the prize and the winner agrees that NeoWorld shall not be liable for any Claim or Loss in connection to the prize or its use.

Warranties

NeoWorld warrants:

the purpose of the Giveaway is to promote the NeoWorld brands and bring awareness to NeoWorld;
entry to the Giveaway is strictly provided as a promotion upon purchasing a Membership and tickets cannot be purchased separately;
the Giveaway is wholly funded by NeoWorld Pty Ltd; and
the Giveaway is solely promoted by NeoWorld Pty Ltd 80 674 654 007 .

Disclaimers

All Entrants consent to NeoWorld sharing the Members’ contact information, such as name, email address, phone number and mailing address, to the Giveaway Partner to facilitate the distribution of the prize and for marketing communications.

To the extent permitted by law, You agree that NeoWorld, or any party acting on behalf of NeoWorld, shall not be liable for any Claim or Loss in connection to the Giveaway and You agree to indemnify NeoWorld, its directors, employees, agents, representatives or affiliates from and against any Claim, damages, liability, cause of action in relation to the Giveaway.

NeoWorld reserves the right to disqualify any Eligible Member abusing or tampering with the Giveaway as determined by NeoWorld in its sole discretion.

NeoWorld reserves the right to suspend, modify or terminate the Giveaway in the

event the Giveaway is compromised by non-authorised human intervention, tampering or any other cause beyond the reasonable control of NeoWorld that corrupts or impairs the security, fairness or proper operation of the Giveaway.

To the extent permitted by law, NeoWorld’s decisions and the results of the Giveaway are final.
